3 Steps to Finding Value in Legal Non-Conforming Properties

Real estate investors need to be very aware of the differences between legal non-conforming properties and illegal as this can make huge differences to the viability and profitability of an investment.

To be considered “conforming”, a property has to fall within the current municipal zoning by-laws. This can include a number of factors including permitted use, setbacks, parking etc. If the property doesn’t meet the current obligations of a particular municipal zoning by-law then it is considered non-conforming.

It is possible to apply for a minor variance or zoning by-law amendment. That means the property could be granted legal status even though it did not comply with the applicable by-laws and may not in the future.
